SHIPPING POLICY
Atelier Elemental Trading Corp.

This Shipping Policy (“Policy”) governs the shipment of orders placed through atelierelemental.ca (the “Site”), operated by Atelier Elemental Trading Corp., a corporation incorporated under the laws of Saskatchewan, Canada, with its principal place of business in Regina, Saskatchewan (“AE,” “we,” “us,” or “our”). This Policy is made available at checkout. By placing an order through the Site, you agree to this Policy as it reads on the date of your order. It should be read together with the other policies posted on the Site.
1. ORDER PROCESSING TIME
Orders are processed and prepared for shipment within one (1) to three (3) business days of purchase. “Business days” means Monday through Friday, excluding statutory holidays observed in Saskatchewan. Each order is manually decanted, inspected, and packed prior to shipment; processing may be extended during periods of high order volume. Orders destined for the United States are processed manually to ensure dangerous goods compliance and may require additional processing time. A shipping confirmation email containing tracking information will be sent to you when your order is dispatched.
2. SHIPPING RATES AND DELIVERY AREAS
All prices and charges on the Site, including shipping charges, are stated in Canadian dollars (CAD) unless expressly indicated otherwise.
Canadian Provinces

Flat rate: $12.99 CAD per order.

Free shipping on orders over $75.00 CAD, calculated before taxes and optional add-ons (including the Priority Package Protection fee).
Canadian Territories (Yukon, Northwest Territories, and Nunavut)

Flat rate: $18.99 CAD per order.

Free shipping on orders over $150.00 CAD, calculated before taxes and optional add-ons.
Territory rates are higher than provincial rates to reflect the increased carrier costs of transporting fragrance products, which are classified as dangerous goods, to these regions.
Service Availability in Remote Communities
Fragrance products may only travel on services approved to carry dangerous goods. Certain remote or fly-in communities are served only by air and cannot receive these products through the services available to us. If we cannot lawfully or practically ship to your address, we will notify you and cancel and refund your order in full in accordance with Section 10.
United States
Shipping charges for U.S. orders are calculated at checkout using live carrier rates and reflect the actual cost of shipping products classified as Class 3 flammable liquids. Low-cost, air-based small-packet services cannot be used for these products, so rates are higher than standard small-parcel rates. There is no free-shipping threshold for U.S. orders; the calculated rate applies regardless of order value. Duties and import charges also apply to U.S. orders — see Section 9. If a compliant shipping service is not available to your U.S. address, we will notify you and cancel and refund your order in full in accordance with Section 10.
Destinations We Do Not Serve
We do not ship to APO, FPO, or DPO military addresses (military mail cannot carry dangerous goods) or to destinations outside Canada and the United States. Orders placed for destinations we do not serve will be cancelled and refunded in full.
3. DANGEROUS GOODS, CARRIERS, AND PACKAGING
Fragrance products contain alcohol and are classified as Class 3 flammable liquids for transport purposes. To comply with the Transportation of Dangerous Goods regulations and carrier requirements:

All orders are packed in leak-proof, shock-resistant packaging designed to prevent breakage or leakage in transit.

Orders are shipped only through carrier services approved to carry dangerous goods in limited quantities, with the marking and packaging those services require.

We may delay, split, repackage, or cancel a shipment where required to comply with carrier or regulatory requirements. If we cancel, you will receive a full refund under Section 10.
4. DELIVERY ESTIMATES; LATE AND UNDELIVERED ORDERS
Delivery timeframes shown at checkout are estimates and depend on carrier performance, weather, customs processing, and other factors outside our control. However:

If your order has not been delivered within thirty (30) days of the estimated delivery date provided to you (or, if none was provided, within thirty (30) days of your order date), you may cancel your order for a full refund, unless delivery was attempted and refused, or you were notified of delivery and the package was not collected.

An order is deemed lost if tracking shows it has not been delivered within fifteen (15) days after the estimated delivery date for Canadian destinations, or thirty (30) days after the estimated delivery date for U.S. destinations. Once an order is deemed lost, Section 5 applies.
5. DAMAGED OR LOST PACKAGES — ALL ORDERS
We stand behind the safe arrival of every order, whether or not you purchase Priority Package Protection.
Damaged arrivals.
If your order arrives damaged (including leakage caused by breakage in transit), contact us within seven (7) days of delivery with your order number and photos of the affected item(s) and packaging. Once verified, we will provide a replacement of the affected items where stock allows or, where a replacement is not available, a refund of the affected items. We aim to resolve verified damage claims within ten (10) business days of receiving a complete claim.
Lost packages.
Once your order is deemed lost under Section 4, we will provide a replacement where stock allows or, where a replacement is not available, a full refund. We may ask for your reasonable cooperation — for example, confirming your shipping address or checking with household members — but we will not require you to wait for the completion of a carrier's internal claim or investigation beyond the timelines in Section 4.
6. PRIORITY PACKAGE PROTECTION (OPTIONAL — $2.99 CAD)
At checkout, you may add Priority Package Protection for $2.99 CAD. Priority Package Protection is an optional priority-claims service provided by AE. It is not insurance, and it does not replace the protections in Sections 4 and 5 or any of your statutory rights — it accelerates them. With Priority Package Protection:

loss claims are accepted as soon as tracking shows non-delivery five (5) days past the estimated delivery date for Canadian destinations, or ten (10) days for U.S. destinations, instead of the standard timelines in Section 4;

we aim to resolve verified damage and loss claims within two (2) business days of a complete claim;
-
you choose the remedy: immediate reshipment (where stock allows) or a full refund of the affected items, instead of the standard replacement-first process; and
-
you will never be asked to wait on a carrier claim or investigation.
The Priority Package Protection fee does not count toward the $75 free-shipping threshold and is non-refundable once your order has shipped, except where AE cancels your order under Section 10, in which case it is refunded in full.
7. ORDER TRACKING
A tracking number will be emailed to you when your order ships. Please allow up to twenty-four (24) hours for tracking information to update after you receive this email.
8. SHIPPING ADDRESS ACCURACY
You are responsible for the accuracy and completeness of the shipping address provided at checkout. If you notice an error after placing your order, contact us as soon as possible; we will make reasonable efforts to correct the address before dispatch but cannot guarantee changes once an order has shipped. If a package is returned to us as undeliverable because of an address error you made, we will, at your choice, refund the product price (less the original shipping charge) once the package is returned to us, or reship the order to a corrected address at your cost. We are not responsible for packages delivered to an incorrect address you provided where the package cannot be recovered.
9. CUSTOMS, DUTIES, AND IMPORT CHARGES (U.S. ORDERS)
All U.S. orders are shipped on a delivered-duty-unpaid basis. Following the suspension of the United States de minimis exemption, duties, taxes, and carrier collection fees generally apply to shipments entering the United States regardless of order value. These charges are set by U.S. authorities and carriers, are your responsibility, and are not included in the shipping charge collected at checkout. The carrier may require payment of these charges before or at delivery.
If you refuse delivery or do not pay required duties and the package is returned to us, we will refund the product price, less the original shipping charge and any return or duty charges imposed on us. Because these products are dangerous goods, cross-border return is not always possible; where a refused or unclaimed package is abandoned, destroyed, or otherwise not returned to us, we are unable to provide a refund.
10. CANCELLATIONS BY AE
If we cancel your order for any reason — including compliance requirements, unavailability of a compliant shipping service to your address, a pricing or listing error, or inability to fulfil — we will notify you and issue a full refund of all amounts paid, including shipping charges and any Priority Package Protection fee, to your original payment method promptly and in any event within fifteen (15) days.
11. YOUR STATUTORY RIGHTS
This Policy sets out our standard service commitments. Nothing in this Policy limits, excludes, or modifies any right or remedy you have under applicable consumer protection legislation that cannot be waived by agreement, including The Consumer Protection and Business Practices Act (Saskatchewan) and the consumer protection laws of the jurisdiction where you live. If anything in this Policy is inconsistent with such a right or remedy, the right or remedy prevails.
12. AMENDMENTS TO THIS POLICY
We may amend this Policy from time to time. The version of this Policy in effect at the time you place an order governs that order. The effective date of the current version is set out above.
13. GOVERNING LAW
This Policy is governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein. This section does not deprive you of the protection of any mandatory consumer protection laws of the jurisdiction in which you reside.

15. LANGUAGE OF THIS POLICY
This Policy is provided in both English and French. For consumers resident in Quebec, the French version prevails in the event of any inconsistency between the two versions. For all other consumers, the English version prevails.
